WareBench — Project Submission & Free Development Terms
Staging draft. Legal review recommended before production publication.1. Scope
These terms describe default conditions under which a person, company or organization may submit a software project to WareBench for possible development without a development fee. They do not oblige WareBench to accept, start, continue, complete, deliver, maintain or support any project.
2. No automatic acceptance
A submission is an invitation to evaluate a problem. WareBench may accept or reject any proposal at its sole discretion and may determine timing, priority, scope, architecture, implementation and release strategy.
3. Right to pause, narrow or stop
Unless a separate written agreement expressly states otherwise, WareBench may pause, narrow, redesign or discontinue work at any time.
4. Free development
Where WareBench expressly accepts a project under this model, WareBench does not charge for its development labour for the accepted scope. Hosting, infrastructure, domains, paid APIs, hardware, commercial licences, contractors and managed operations are not automatically included.
5. Public release and reuse
The commissioning party acknowledges that the economic basis of the model is non-exclusivity. WareBench may publish, distribute, demonstrate, reuse, modify, fork, extend and continue developing project software and associated non-confidential technical materials through public source repositories.
6. Software licence
The exact licence is stated in the origin repository. Unless WareBench decides otherwise, the default intention is a strong copyleft open-source licence intended to keep source and distributed derivative works under reciprocal open terms. The repository licence controls software-use rights.
7. Attribution and origin
As between WareBench and the commissioning party, the commissioning party agrees not to falsely represent the origin of WareBench work or deliberately remove WareBench and origin-repository attribution that forms part of delivered materials, notices or applicable licence requirements. Downstream obligations exist only where validly imposed by the applicable licence or another binding agreement.
8. Portfolio and marketing permission
By submitting and then proceeding with a project under this model, the commissioning party grants WareBench a worldwide, non-exclusive, royalty-free permission to identify the organization and use its name, branding supplied for the project, project communications supplied to WareBench, screenshots, descriptions, results, and content from the organization’s public websites or project sites for WareBench portfolio, case-study, demonstration and marketing purposes. Material expressly accepted by WareBench in writing as confidential before disclosure is excluded.
9. Rights in supplied material
The commissioning party represents that it has the rights and authority needed to provide materials and grant project permissions. Third-party materials remain subject to their own rights.
10. No exclusivity
Unless separately agreed in writing, no project, feature, method, architecture, design pattern or general solution developed by WareBench is exclusive to the commissioning party.
11. No warranty
Unless separately agreed in writing, free-development work is provided “as is” and “as available” to the maximum extent permitted by applicable law, without a commitment to service level, roadmap, maintenance period or fitness for a particular purpose.
12. Security
Submissions must not contain passwords, private keys, production credentials, regulated secrets or sensitive personal information unless an approved secure channel has been established.
13. Separate paid services
Hosting, managed cloud operation, support, private deployment, custom service levels, migration, maintenance or other operational services may be offered separately.
14. Changes and project-specific terms
WareBench may update these defaults. Project-specific written terms may supersede them for a particular project.
15. Contact
All contact through this website takes place through the website form. No public email address or telephone contact is provided.
